Student acquitted of unlawful sex with classmate

Eastern Court on Friday acquitted a male student of having unlawful sex with a female schoolmate in 2019, when he was 14 and she was 13.

The defendant was found not guilty of one count of indecent conduct towards a girl under 16, two counts of unlawful sexual intercourse with a girl under 16, and one count of procurement by threats.

Handing down her judgement, magistrate Leung Ka-kie said the court couldn’t rely on the evidence of the accuser, noting that she had admitted under cross-examination that a friend had given her advice on testifying.

Leung said the prosecution had not proven beyond reasonable doubt that the defendant was guilty of the charges against him.

The court ordered that the prosecution must bear the legal costs for the case.
